NEW YORK STATE FOLLOWS WHAT’S RECOGNIZED AS
PRIOR VICIOUS PROPENSITIES RULE.
Under this Law, an owner is responsible for an injury caused by their dog only if they knew (or should have known) the dog was likely to cause an injury and has shown vicious propensities.
Vicious propensities can be established if the dog has bitten before or engaged in very aggressive behavior, such as growling or leaping at people.
